Trademark rights are protection for trademark owners registered with the DJKI. By having one form of protection for Intellectual Property Rights (HKI), the owner can use the trademark/business exclusively. A mark can be a sign that can be displayed graphically, such as an image, logo, name, word, letter, number, color arrangement, in two or dimensional form, sound, hologram, or a combination of two or more of these elements.
The function of a brand is to distinguish goods or services produced by individuals or legal entities in the goods/services trading business activity. The differentiation between a brand and that of another party can be in the form of images, words, names, phrases, numbers, colors to sentences, or a combination of these elements. Each trademark can be registered with the DJKI as long as it is not the same as that of another registered party. Once registered, the trademark owner can prohibit other parties from using it. A trademark registration Indonesia system with the DGIP can obtain legal protection for 10 years from the date of receipt of the application for registration. The period of protection can also be extended.
Registering Trademark Rights Online
The process of registering intellectual property rights is now easier because it can be done online. Starting August 17, 2019, the Directorate General of Intellectual Property (DJKI) has provided facilities that allow registration of trademark rights, industrial designs, and patents online. Online registration of trademarks, designs, and patents can be done through an online intellectual property registration (IP) application.
The application was launched right on the commemoration of Indonesia’s 74th independence day this year. “People no longer have to carry a lot of application documents. Registration can also be done at the office of each consultant or society from any circle, no need to go to the DJKI office, ”said the Director-General of Intellectual Property (Dirjen KI), Freddy Harris in Jakarta, Saturday (17/8/2019).
